Mount Morris Sex Offender Let's the Bird Fly

GENESEE SUN - "The Mount Morris man who pled guilty to a felony sex offense received his sentence Tuesday morning.

Kyle Kibler, 21, pled guilty to felony Possessing a Sexual Performance by a Child in June. Judge Robert Wiggins sentenced him to four months of weekends in jail and 10 years of probation on Tuesday.

Kibler shook his head and said, barely audibly, ‘no,’ when Judge Robert Wiggins asked if he’d like to comment before sentence.

Kibler will have to pay $1,425 in court fees and surcharges and register as a sex offender.

A sex offender Risk Assessment Instrument scale determined and District Attorney Greg McCaffrey agreed that Kibler should be a level 1 sex offender, at least risk to re-offend.

“There is no basis to deviate from a level 1 adjudication,” said McCaffrey.

McCaffrey noted at a previous court appearance that the FBI, which assisted New York State Police with the arrest in 2016, are no longer considering pressing federal charges in this case.

Though he was free to leave the courthouse after sentencing on Tuesday, Kibler stayed inside for over half an hour to try and duck reporters."
